Terms and Conditions
DWG PLANS Ltd is an architectural services company covering the South of England, providing clients with professional computer-generated drawings for extension work, which include existing and proposed elevation views, floor plans and roof plans needed to process residential planning applications. DWG PLANS Ltd are draughtsman rather than architects and as such do not belong or are members of The Royal Institute of British Architects (RIBA).
The following terms and conditions shall form the basis of a contract between the client (“Client”) and DWG Plans Ltd (“Firm”) in the event that the client decides to proceed and accepts this proposal:
- The Firm agrees to provide the services outlined in this proposal for the fee outlined on the quote.
- The Client undertakes to pay the fee set out above in accordance with the agreed payment terms.
- The Firm undertakes to consult with the Client in order to facilitate the completion of the agreed milestones above.
- The Client undertakes to provide the Firm with clear instructions and guidance when required and supply accurate information if using the client’s sketches. Any dimensions taken by the client is the client’s responsibility should these be in-accurate.
- The Firm will ensure compliance with all relevant laws and regulations.
- The Firm shall undertake all of its work with professionalism and due care.
- The Client undertakes not to withhold payment for any reason. If the Client requests to withdraw from employing the Firm after this contract has been accepted, then a payment of 50% of the total sum will be charged. Interest will be paid at 10% of the total sum of the amount owed if payment has not been received 7 days after the invoice has been sent.
- The invoice is usually sent once the client has confirmed their satisfaction of the drawings. Payment is required within 7 days. Every week not paid from this date 10% interest is added to the total owed. If the pans have been completed and sent to the client, and the client does not respond with any changes within 1 calendar week, then DWG Plans will take this as approval of design and an invoice will be sent for prompt payment.
- Should the client decide not to proceed with submitting the plans to the council than an invoice will be sent for works carried out up to that point. The client is required to settle this invoice within 7 days of this date. For every week not paid from this date 10% interest is added to the total owed.
- Should the client decide not to proceed with the plans after the survey has been carried out then a survey fee of £550+VAT will be invoiced. The client is to inform DWG Plans Ltd the same day.
- Any subsequent agreements between the Firm and the Client shall be added as separated signed and dated appendices and will override the terms of this architectural proposal.
- The Firm is not responsible for delays due to outside agencies such as planning or government authorities, builders’ merchants, shipping and transit companies and third-party contractors.
- The Firm is not responsible for delays due to unforeseen eventualities or acts of God such as poor weather, flooding, natural disaster etc.
- The Client agrees to the Firm photographing the property for reference.
- The Client agrees to the Firm using drawings created for the project for advertising and promotional purposes on the condition that all identifiable and personal information is omitted.
- The Firm does not take any responsibility for any amendments or modifications which are requested by the Client’s local council following the submittal of the planning application. Subsequent amendments are charged at £200+VAT per revision.
- The Firm does not take any responsibility for any information or drawings supplied by Sub-contractors or third parties.
- If the client wishes the Firm to submit the planning application forms to the client’s local council the application fee will need to be paid to the Firm before the application is submitted.
- The Firm does not take any responsibility for any additional information the local planning authority asks for after the planning application has been submitted. Any additional information that incurs a cost will be passed on to the client and will have to be paid directly to the third party.
- The firm does not guarantee that planning approval will be granted. The decision is for the client’s local council to decide.
- The firm does not take responsibility for any measurements provided by the client if a survey has not been taken specifically by the firm.
- All quotes are valid for 30 days unless sated otherwise.
- It is the responsibility of the client to address any build over consent or repositioning of inspection chambers and drains and obtain permission from their local water board. - It is the responsibility of the client to check if they require and obtain party wall agreements.
- The verbal or written consent from the client to engage the firm in employment will be taken that the client agrees to the terms and conditions in this contract even if this contract is not signed.
- It is the responsibility of the client to remove any planning conditions that the approval letter refers to.
Quotes do not include 3rd party disbursements including but not limited to party wall agreements, building regulation application fees, tree surveys, ecology reports, bio-diversity statements, flood risk assessment, acoustic assessment, structural engineer calculations, SAP, ground investigation, sewer records, water consumption calculations, conditional lift, mechanical and electrical schematics, bat surveys.
Drawings provided for Building Regulation Approval are only usually produced once planning has been approved. Once the plans have been produced, DWG Plans Ltd will email the drawings to the client. Any changes to the design at this stage will incur an additional charge and may be subject to a material or non-material amendment with the council. It is important that the client is content with the plans.
Our quotes do not include the submittal of the plans to Building Control. We can help with obtaining quotes for building Control approval if requested.
I can provide the client with contact details for a local Structural Engineer. Fees for the Structural Engineer will need to be paid directly to that firm and DWG Plans Ltd does not take any responsibility of the information provided by the Structural Engineer.
Party Wall Agreement may be required between you and your neighbour. For more information on Party Wall Agreement please visit the government website for more details https://www.gov.uk/party-walls-building-works.
Building over a drain or an inspection chamber may be required. DWG Plans Ltd suggests that the client contacts their local water board to find out firstly if the drains and chambers are privately or publicly owned. If they are publicly owned, then permission from the water board will need to be sought. They may need to do a CCTV survey to distinguish the run and depth of the drains. DWG Plans Ltd will endeavour to capture all the information required for planning and building regulation drawings on the first survey visit, however, if any dimensions, photos or other information is required, the client would be obliged to provide this additional information.
The council may request a bio-diversity checklist to be submitted. DWG Plans will roughly fill in the form and send to the client to fill in the blanks or modify. Please ensure the information is correct including client names and address. The client is responsible for the information within this form.
New legislation came into effect under the Building Regulation 2010 act (amended 2023) and CDM 2015 act This change introduced 5 duty holders all having their own duties and responsibilities including the client, designer and contractor. As part of this act DWG Plans will issue the client a client care letter outlining their roles and responsibilities along with a Principal designer agreement letter informing the Client that a branch of DWG Plans (Chilterns and Surrey Hills) can act as the Principal Designer for the Building Regulations for their project if they choose to do so at an additional cost.
